Terms and Conditions of Sale and/or Delivery of Product
Pick Up of Material: All Seasons Mulch.com is not responsible for personal or property damage that may occur during the loading process. By allowing us to load your vehicle, you assume any and all liability that may be associated with said loading process. It is highly recommended to use a cover to minimize damage from loose product.
Delivery of Product: Will be made only at the customer’s request to a designated drop site for a flat nominal fee. Deliveries will be made during normal operating hours. Drop site refers to where you would like material placed upon delivery. Customers are asked to mark the location where product should be dropped. Please note that once All Seasons Mulch.com leaves the county maintained road or state highway, customer assumes any and all liability for damages incurred to personal property, as well as, but not limited to, damage to All Seasons Mulch.com vehicles, including, but not limited to towing expenses.
Additionally, whether a contractor or homeowner, customer agrees to hold All Seasons Mulch.com harmless for any and all personal injury or property damage caused by materials and/or the dumping thereof at customer’s request.
Drivers will do their very best to drop product at customer’s request bearing in mind the weight of the vehicle, height, and width of the vehicle and overhead restraints required for dump height when body is raised. Additional signature at drop site is required for drivers to dump any location other than the driveway.
Guarantee of Product: All Seasons Mulch.com guarantees the quantity and/or weight of materials charged on delivery invoice by using the LOADRITE™ on-board payload weighing systems for wheel loaders. All Seasons Mulch.com sells premium landscape materials that are quality standard in the landscape industry. However, All Seasons Mulch.com makes no warranties for any material and/or supplies, including, but not limited to, sod. If you are not satisfied with the quality or quantity of your product and/or materials, please contact us immediately within 24 hours. All Seasons Mulch.com prides itself on customer satisfaction and we want to hear your comments and/or suggestions!
Terms of Payment: Unless otherwise agreed upon, all materials will be paid for prior to pick up or delivery of said product. Terms on all approved credit accounts will assume NET 30 days; any and all outstanding monies owed for materials and/or supplies will be charged finance charges after 30 days at a rate of 1.5% per month or 18% per annum. Customer assumes all fees associated with collection costs, including, but not limited to, attorney’s fees, arbitration fees, and/or court costs. All Seasons Mulch.com reserves the right to place a lien on a property where materials and/or product was delivered and/or installed. All Seasons Mulch.com reserves the right to place a lien on any property on said products and/or labor. Property owner is subject to a lien, even if he or she has made full payment to the contractor ordering these materials.
Prices and Product Availability: All Seasons Mulch.com reserves the right to change prices without notification. While we try to maintain adequate inventory levels, in stock product cannot always be guaranteed but we will do our very best to obtain any supplies you need of in stock product as soon as the product becomes available by our suppliers.
Picture Disclaimer: Pictures and/or descriptions on our website are strictly used to provide the consumer with an idea of the product appearance and/or use of said product. For best results, it is best to view the product in person on location at the time the order is placed to ensure your total satisfaction.
